DMCA Takedown Policy

Last updated: March 10, 2026

Shafee Technologies is committed to protecting the intellectual property rights of creators and rights holders. This policy outlines how copyright owners can report infringing content on Shafee and how affected users can respond.

1. Introduction

Shafee Technologies ("we", "our", or "us") respects the intellectual property rights of artists, creators, and rights holders. We are committed to responding to notices of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act (DMCA), South Africa's Copyright Act, and other applicable intellectual property laws. This policy describes how to report copyright infringement on Shafee and what happens when we receive a valid notice.

2. Designated Copyright Agent

Our designated agent for receiving DMCA takedown notices is:

  • • Shafee Technologies

  • • Attn: Copyright Agent

  • • Email: copyright@shafee.app

3. Filing a DMCA Takedown Notice

If you believe that content on Shafee infringes your copyright, you may submit a written takedown notice to our Copyright Agent. Your notice must include all of the following:

  • • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

  • • Identification of the copyrighted work you claim has been infringed. If multiple works are involved, provide a representative list.

  • • A description of the material you claim is infringing and its location on Shafee, with enough detail for us to find it (e.g., a URL or link to the content).

  • • Your contact information, including your full name, mailing address, telephone number, and email address.

  • • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

  • • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

4. How We Process Takedown Notices

When we receive a valid DMCA takedown notice, we will:

  • • Review the notice to confirm it meets the requirements above.

  • • Remove or disable access to the allegedly infringing material promptly.

  • • Notify the user who uploaded the content that the material has been removed and provide them with a copy of the notice.

  • • Maintain a record of the notice and any actions taken.

5. Filing a Counter-Notice

If you believe your content was removed in error or that you have authorization to use the material, you may file a counter-notice. Your counter-notice must include:

  • • Your physical or electronic signature.

  • • Identification of the material that was removed and the location where it appeared before removal.

  • • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  • • Your name, address, and telephone number.

  • • A statement that you consent to the jurisdiction of the applicable court in your district (or, if you are outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who filed the original takedown notice or their agent.

6. Counter-Notice Process

When we receive a valid counter-notice, we will:

  • • Forward the counter-notice to the original complainant.

  • • Inform the complainant that the removed material will be restored in 10 business days unless they file a court action seeking to restrain the user from the allegedly infringing activity.

  • • Restore the material within 10 to 14 business days after receiving the counter-notice, unless the complainant notifies us of a filed court action.

7. Repeat Infringer Policy

Shafee maintains a policy for the termination of accounts of users who are repeat infringers. We may, in appropriate circumstances and at our sole discretion:

  • • Issue warnings to users who receive their first valid infringement notice.

  • • Temporarily suspend the upload privileges of users who receive multiple valid notices.

  • • Permanently terminate the accounts of users who are repeat infringers.

  • • Consider the nature and severity of the infringement when determining appropriate action.

8. Misrepresentation Warning

Please be aware that under the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorney's fees. Do not file a takedown notice or counter-notice unless you are certain of your claim.

9. Accommodation of Standard Technical Measures

Shafee accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, as defined in the DMCA.

10. South African Copyright Law

In addition to DMCA compliance, Shafee also operates under South African copyright law. Rights holders in South Africa may submit infringement notices under the Copyright Act 98 of 1978 and the Cybercrimes Act 19 of 2020. The process and required information is substantially similar to the DMCA notice requirements outlined above. Send all notices to copyright@shafee.app.
