Welcome to Shafee! By accessing or using our platform, you agree to be bound by these Terms of Use and our Privacy Policy. If you don't agree to these terms, please don't use Shafee.

2. The Shafee Platform

Shafee is a music and video streaming platform that connects artists directly with listeners. Artists can upload and share their original content, and we pay them per stream. No record labels or intermediaries - just artists, content, and fans.

3. Your Account

To use certain features of the platform, you need to create an account. When you do:

• • You must be at least 13 years old (or the minimum age in your country)

• • Provide accurate and complete registration information

• • Keep your password secure and confidential

• • You are responsible for all activities under your account

• • Notify us immediately of any unauthorized use

• • You may not transfer your account to anyone else

4. Content and Copyright

Your Content:

• • You retain ownership of content you upload to Shafee

• • You grant us a license to host, store, distribute, and publicly perform your content

• • You must own or have rights to all content you upload

• • You are responsible for ensuring your content doesn't infringe on others' rights

• • You represent that your content complies with these Terms

5. Artist Payments and Monetization

For artists uploading content:

• • We pay artists directly based on streams of their content

• • Artists must agree to our Artist Agreement (available at shafee.app/artist-agreement)

• • Payment rates and detailed terms are available in your Artist Dashboard

• • You must provide valid payment information to receive earnings

• • We reserve the right to withhold payment for fraudulent activity

• • Minimum payout thresholds may apply

6. Prohibited Content and Conduct

You agree not to upload or share content that:

• • Infringes on intellectual property rights of others

• • Contains hate speech, harassment, or promotes violence

• • Is sexually explicit or pornographic

• • Violates any laws or regulations

• • Contains spam, malware, or viruses

• • Impersonates others or is fraudulent

• • Exploits or harms minors in any way

• • Is generated primarily by AI without significant human creative input (we reserve the right to restrict or demonetize AI-generated content)

7. User Conduct

You agree not to:

• • Use bots, scripts, or automation to inflate plays or engagement

• • Circumvent or manipulate our payment systems

• • Scrape, harvest, or collect user data without permission

• • Interfere with or disrupt the platform or servers

• • Attempt to gain unauthorized access to any part of the service

• • Use the platform for any illegal or unauthorized purpose

8. Subscriptions and Payments

If you subscribe to premium features:

• • Subscriptions automatically renew unless cancelled

• • You authorize us to charge your payment method

• • Subscription fees are non-refundable except as required by law

• • We may change subscription prices with 30 days' notice

• • You can cancel anytime from your account settings

9. Intellectual Property

The Shafee platform, including its design, features, and functionality, is owned by Shafee Technologies and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works without our written permission.

10. AI-Generated Content

Shafee supports human creativity and artistry. Regarding AI-generated content:

• • Content generated primarily by AI tools must be clearly labeled as such

• • We reserve the right to restrict, demonetize, or remove AI-generated content

• • AI-assisted content (where AI is a tool in human creative process) may be acceptable

• • Our AI content policy may evolve as the technology and legal landscape develops

• • Artists using AI tools should retain documentation of their creative process

11. Takedown and Content Removal

We respect intellectual property rights and comply with applicable copyright laws, including the DMCA. If you believe content infringes your rights, please see our full DMCA Takedown Policy at shafee.app/dmca or contact us at copyright@shafee.app with detailed information. We may remove content that violates these Terms or applicable law.

12. Termination

We may suspend or terminate your account if you violate these Terms. You may close your account at any time. Upon termination:

• • Your access to the platform will cease immediately

• • We may retain certain data as required by law or for legitimate business purposes

• • Outstanding payments owed to artists will be processed according to our payment terms

• • Subscriptions will be cancelled (no refunds for partial periods)

13. Disclaimers and Limitations

Shafee is provided "as is" without warranties of any kind. We don't guarantee:

• • Uninterrupted or error-free service

• • Accuracy or reliability of content

• • That content will always be available

• • Specific results from using the platform

14. Limitation of Liability

To the maximum extent permitted by law, Shafee Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of Shafee.

15. Indemnification

You agree to indemnify and hold Shafee Technologies harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your content, or your violation of these Terms.

16. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or in-app notification at least 30 days before taking effect. Continued use after changes means you accept the new Terms.

17. Governing Law and Disputes

These Terms are governed by the laws of South Africa. Any disputes will be resolved through binding arbitration in South Africa, except where prohibited by law. You may have additional consumer rights under local law.
